Smile Marketing Terms of Service – Essential PlanSmile Marketing Terms of Service – Essential Plan
Your first monthly service fee will be due within two business days. After the initial 12-month agreement, your subscription will automatically renew on a month-to-month basis until terminated by either party with 30-days written notice.
1. Website Design & Setup
- Website Production Specialist. Your experienced specialist will guide you and your team through the process to design, develop and launch your Smile Marketing website. We will provide access for you to review and approve your website prior to launch.
- Content Interview. As part of the development phase of your Smile Marketing website, your Website Production Specialist will establish a mutually convenient time to conduct and record a telephone interview with you and/or your team. The results of this interview will guide our writing team to create unique content for up to eight essential pages including: home page, practitioner bio/s, about us, contact us and other new patient converting content from the interview. If your current website includes additional pages, we will re-publish this content to your new website in order to preserve any search engine authority. Additional pages can be added and customized from our library of high-quality stock content as needed.
- Website Design. Your Website Production Specialist will coordinate your design brief and direct our graphics team to create your website design. We will provide a design proof for you to review and approve. You will have the opportunity to make up to three rounds of revisions to your design; any additional rounds of revisions may incur a fee.
- Search Engine Optimization “SEO”. Your Website Production Specialist in collaboration with our SEO team will liaise with you to determine the primary jurisdiction (new patient drawing area) of your practice and optimize your site for the major search engines and essential directories in order to generate quality website traffic.
- Exclusive Directories. Our SEO team will list your practice and one dentist on SmileGuide.com.
- Patient Database. Your Website Production Specialist will coordinate a one-time import of your existing patient database as subscribers of your website to receive; your monthly practice newsletter, monthly blog email, practice announcements, birthday and seasonal greetings. Patients may unsubscribe from receiving these communications at any time.
2. Monthly Website Service
- Website Updates. Our support team will collaborate with our dedicated website editing team to add/edit/delete pages or posts on your website as requested by you or your team.
- Your Website Dashboard.. We will provide login credentials to your website dashboard where you and other authorized team members may:
- Add new patients as website subscribers to receive; your first visit practice survey, monthly practice newsletter, blog post email, e-Learning curriculum, practice announcements, birthday and seasonal greetings. Subscribers may unsubscribe from receiving these communications at any time.
- Add, edit or delete website pages, blog posts and office hours.
- Compose and send your own personalized emails to all or selected lists of website subscribers.
- Download a printable version of your monthly practice newsletter for distribution to patients who are not website subscribers.
- Preview the monthly newsletter and weekly blog posts we create on your behalf prior to publishing them to your website.
3. General Terms
- Information you provide Smile Marketing is treated as confidential in accordance with relevant patient privacy statutes for your jurisdiction and our privacy policy published here: www.smilemarketing.com/privacy
- You certify that you have the rights, permissions and releases to post text, images or video content that you self-publish or supply to Smile Marketing for publishing.
- You agree to review and update the provided website privacy policy as needed to reflect your practice privacy policy, and verify that as part of your policy, patient contact via email is an extension of your privileged doctor/patient relationship.
- You acknowledge that all Smile Marketing supplied text, images and software is copyrighted by the respective copyright holders listed at: www.smilemarketing.com/copyright. You may not reproduce or create derivative works from our content for use in any media, now or in the future, without the express, written permission of Smile Marketing.
- You understand and acknowledge that should you cancel your service with Smile Marketing, you will be responsible for creating a new website design and hosting your own files, content, and images. You acknowledge that you may not copy your Smile Marketing website to be hosted elsewhere.
- Any stock content, including images, from your website that are provided by Smile Marketing remains the property of Smile Marketing and cannot be used elsewhere. This includes newsletter articles, blog posts, and stock imagery. We will provide you with a copy of your unique, custom content upon request.
- You agree to comply with our acceptable use guidelines, which we may change from time to time. We reserve the right to discontinue service due to, but not limited to: publishing private, illegal, defamatory, obscene, slanderous or inappropriate materials; fraud; copyright infringement; non-payment of service; abandonment or non-responsiveness; abusive behavior towards our team and/or website resources including email services.
- You acknowledge that adding each new patient as a subscriber of your website is the only way to derive full value from your service with Smile Marketing. Features like the New Patient Survey, monthly newsletter, and email marketing console rely on your patient list being subscribed through the website dashboard.
- All website-generated patient emails will be CAN-SPAM compliant, containing a provision for each patient to unsubscribe from receiving future communications.
- Neither party will be liable for its inability to abide by these terms, or for any interruption in the service due to weather, disaster, terrorism, Internet access, routine server maintenance or acts of God.
- Smile Marketing reserves the right to change the terms of this agreement by submitting such changes in writing within 30 days prior to the expiration of this agreement.
- Australian prices quoted are not inclusive of GST.

- Professional Photography. Your Website Production Specialist will coordinate the scheduling of your practice photoshoot session with our photography partner/s. You agree to schedule in a timely manner and review all guidelines and information provided to prepare you and your team for a successful photography session.
- Website Design. Your Website Production Specialist will coordinate your design brief and direct our graphics team to create your custom website design. We will provide a design proof for you to review and approve. You will have the opportunity to make up to three rounds of revisions to your design; any additional rounds of revisions may incur a fee.
- Social Media Branding. After you’ve approved your website design, our designers will create custom social branding files that will complement your new website and unify your brand identity across your social platforms.
- Search Engine Optimization “SEO”. Your Digital Marketing Specialist in collaboration with our SEO team will liaise with you to determine the primary jurisdiction (new patient drawing area) of your practice and optimize your site for the major search engines and essential directories in order to generate quality website traffic.

- Digital Marketing Strategy. Your dedicated Digital Marketing Specialist will partner with you on a digital strategy that promotes practice growth, including, but not limited to, email marketing, social media, custom content, 5-star review generation, SEO, and more.
- Ongoing SEO. Your website performance and traffic is monitored regularly for success. Based on these reviews, as well as your new patient results, we identify areas for improvement and partner with you to expand your reach which may include a strategy to target your top three revenue generating services.
- Website Performance. Your Digital Marketing Specialist will use analytics, reporting software and other tools to monitor website performance and make ongoing enhancements to maximize its new patient results. You’ll receive a monthly report showing the key metrics and performance of your website.
- Social Media. Integrated right into your website dashboard, you’ll have instant access to our library of social media posts focused on engaging dental patients, plus brand new posts added each week. Review, customize, and schedule them to post to Facebook and Instagram right from your dashboard.
- Website Updates. Your Digital Marketing Specialist will collaborate with our dedicated website editing team to add/edit/delete pages or posts on your website as requested by you or your team.
- Website Design. To keep your website up-to-date, you are entitled to a complimentary website redesign every three years.
- Your Website Dashboard. Your Digital Marketing Specialist will provide login credentials to your website dashboard where you and other authorized team members may:

Smile Marketing Terms of Service – Ultimate Plan
Your first monthly service fee will be due within two business days. The initial contract is 12 months. At the 9-month mark, we will do an in-depth formal review and discuss renewal options.
1. Website Development
- Website Production Specialist. Your experienced production specialist will guide you and your team through the process to design, develop and launch your Smile Marketing website in collaboration with your dedicated Digital Marketing Specialist. We will provide access for you to review and approve your website prior to launch.
- Content Interview. As part of the development phase of your Smile Marketing website, your Website Production Specialist will establish a mutually convenient time to conduct and record a telephone interview with you and/or your team. The results of this interview will guide our writing team to create unique content for essential pages including: home page, practitioner bio/s, about us, contact us and other new patient converting content from the interview. If your current website includes additional pages, we will refine this content to improve user-experience and SEO then publish to your new website in order to preserve any search engine authority. Additional pages can be added and customized from our library of high-quality stock content as needed.
- Professional Photography. Your Website Production Specialist will coordinate the scheduling of your practice photoshoot session with our photography partner/s. You agree to schedule in a timely manner and review all guidelines and information provided to prepare you and your team for a successful photography session.

- Exclusive Directories. Your SEO Specialist will list your practice and one dentist on SmileGuide.com.
- Patient Database. Your Digital Marketing Specialist will coordinate a one-time import of your existing patient database as subscribers of your website to receive: your monthly practice newsletter, monthly blog email, practice announcements, birthday and seasonal greetings. Patients may unsubscribe from receiving these communications at any time.
- New Patient Numbers. You will provide your DMS with a report of your average new patient numbers for the previous 6 months. This will establish a benchmark for us to build on and report on ROI from our marketing efforts.
2. Monthly Website Service
- Digital Marketing Strategy. Your dedicated Digital Marketing Specialist will partner with you to achieve your new patient goals with a digital strategy that leverages our proven Five Factors of Digital Marketing Success model including a high-converting website, organic and paid traffic, reviews/reputation management, email marketing, and social media.
- Ongoing SEO. Your website performance and traffic is monitored by your SEO Specialist regularly for success. Based on these reviews, as well as your new patient results, we identify areas for improvement and partner with you to expand your reach which may include link building, additional directory submissions, and other strategies to improve rankings in a highly competitive jurisdiction or to target your top revenue generating services. And, as agreed upon with our sales team, there may be a separate additional investment per month for advanced link building the first 12 months with a review at 9 months and a possible extension as required.
- Website Performance. Your Digital Marketing Specialist will use analytics, reporting software, your new patient reports (provided upon sign up and on an ongoing basis) and other tools to monitor website performance and make ongoing enhancements to maximize its new patient results. You’ll receive a monthly report showing the key metrics and performance of your website.
- Social Media. Integrated right into your website dashboard, you’ll have instant access to our library of social media posts focused on engaging dental patients, plus brand new posts added each week. Review, customize, and schedule them to post to Smile Marketing Terms of Service – Social Only Plan right from your dashboard.
- Call Tracking and Conversion Coaching. Your website and business listings on the most popular online platforms (for example, Google My Business, Yelp, and Facebook) will be set up with tracking phone numbers to track where new patient calls are coming from and provide proof of ROI. Your Digital Marketing Specialist will study your call recordings and other new patient conversion data and provide coaching to your front office team to convert more new patients over the phone. You have full access to your call recordings at any time. Coaching also includes email and other new patient conversion strategies.
- Website Updates. Your Digital Marketing Specialist and SEO Specialist will collaborate with our dedicated website editing team to add/edit/delete pages or posts on your website as requested by you or your team.
- Website Design. Included with your subscription, we will update your website design every three years.
- Your Website Dashboard. Your Digital Marketing Specialist will provide login credentials to your website dashboard where you and other authorized team members may:

- Area Exclusivity. We agree to not take on any other client at the Ultimate Plan level for your primary jurisdiction as determined by your initial SEO review, unless a radial boundary has been agreed upon at the time of sale. You understand and acknowledge that we may have other clients at the Essential and/or Premium level in your area.
- Marketing Partnership. You acknowledge that this partnership will be most successful with open lines of communication and you understand that there are certain digital marketing strategies that will require your hands-on involvement to be implemented effectively.

1. Paid Advertising
- Identity Verification: Smile Marketing may request identity verification documentation in accordance with applicable laws and regulations for advertising in your jurisdiction.
- Intellectual Property: Smile Marketing retain ownership of all intellectual property related to our paid advertising services, including the ad copy, landing pages, campaign setup, keyword and negative keyword strategy, and all other aspects.
- Access to Real Time Data: You will have access to real-time data from the campaign through your reporting dashboard as long as your ads are active. Access to the data will be terminated upon cancellation. Please note that we do not provide clients with access to the actual Google Ads account.
- User Access: You may request to add any user you wish to your reporting dashboard, but access to your Google Ads account will not be given to third parties, competitors or others.
- One-Time Setup Fee: A one-time setup fee is required to initiate Paid Advertising services. If your advertising campaign has been inactive for a period of six months or more, an additional setup fee may be necessary to reactivate and reconfigure your campaign.
- Results May Vary: The effectiveness of our campaigns can vary depending on a variety of factors, such as market conditions, budget, new patient specials, insurance status, and practice hours. While we strive to provide the best possible recommendations during our presale review, we cannot guarantee specific results.
- Marketing Restrictions: You understand and acknowledge that it is your responsibility to inform us of any marketing restrictions applicable to your jurisdiction. You may request to review your ad copy and landing page(s) prior to launch to ensure compliance with regulations. Smile Marketing is not liable for any legal consequences arising from non-compliance with such restrictions.

Smile Marketing Terms of Service – Social Only Plan
Your first monthly service fee will be due within two business days. Your monthly subscription will continue on a month-to-month basis until terminated by either party with 30-days written notice.
1. Monthly Service
- Dashboard Access. We will provide login credentials where you and other authorized team members may login to the Get Social dashboard and connect your business Facebook and Instagram accounts.
- Get Social. You’ll have instant access to our library of social media posts focused on engaging dental patients, plus brand new posts added each week. Review, customize, and schedule them to post to Facebook and Instagram right from your dashboard.
- Support. You may request support in the dashboard by clicking “Request Support” or through our chat feature (available during our business hours listed on www.smilemarketing.com/contact-us). Our team will respond to all support requests within 2 business days.
2. General Terms
- Information you provide Smile Marketing is treated as confidential in accordance with relevant patient privacy statutes for your jurisdiction and our privacy policy published here: www.smilemarketing.com/privacy
- You certify that you have the rights, permissions and releases to post text, images or video content that you self-publish. You acknowledge that all Smile Marketing supplied text, images and software is copyrighted by the respective copyright holders listed at: www.smilemarketing.com/copyright. You may not reproduce or create derivative works from our content for use in any media, now or in the future, without the express, written permission of Smile Marketing.
- Any stock images provided by Smile Marketing remain the property of Smile Marketing and cannot be downloaded and used in your other marketing initiatives.
- You agree to comply with our acceptable use guidelines, which we may change from time to time. We reserve the right to discontinue service due to, but not limited to: publishing private, illegal, defamatory, obscene, slanderous or inappropriate materials; fraud; copyright infringement; non-payment of service; abandonment or non-responsiveness; abusive behavior towards our team and/or resources.
